What should you do if you are in a motor vehicle accident?

Follow these steps if you are involved in a Motor Vehicle Accident:

  • Call 000 if needed. Check if anyone has been injured by the accident; if anyone is hurt call an ambulance and the police immediately.
  • Report the accident. This should be done within 24 hours of the accident and failing to do so is an offence and may affect your compensation claim. Make sure you write down the event number that the police give you.
  • Exchange contact details. Get the registration number, license number, and insurance detail of the other driver and car.
  • Make a claim. Complete a personal injury claim form from your green slip insurer and send it to them within at least 6 months from the date of the accident.
  • Talk to the Insurer. Contact the insurer of the driver that is considered "at fault" and let them know that you want to claim personal injury compensation using a "notice of claim" form.

What do I need to claim Motor Vehicle Accident compensation?

If you have been injured in a motor vehicle accident you should act without delay.  There are time limits that apply to the making of a claim and various procedural requirements that you must attend to.  Should you wish to make a claim, you should attend to the following steps:

  • Ensure you write down the registration number of the vehicle that caused the accident and get the driver’s details and licence number.
  • Make a note of the location of the accident and the nearest cross street.
  • If the police did not attend at the scene of the accident, you must report the accident to NSW Police within 28 days (if possible).  If you have been injured in an accident and it is already 28 days since the accident – you must report the matter as soon as possible!
  • Attend at your doctor and advise him / her that you have been injured in a motor vehicle accident.  Your doctor will be able to advise you as to any treatment that you should have in relation to your injuries.
